La sañosa guerra del Ejecutivo y Legislativo federales contra el Poder Judicial cobró forma el viernes de un franco, abierto desacato de la presidenta Claudia Sheinbaum a una suspensión definitiva concedida por una jueza de amparo contra la publicación y aplicación de la reforma que ha sumido al país en una funesta crisis constitucional.
Desobedecer desde las alturas esa resolución crea un escandaloso y preocupante precedente.
Más allá de si la juzgadora tiene o no facultades para emitir la suspensión (es constitucional y convencionalmente debatible la prohibición del Artículo 61 de la Ley de Amparo), existen los únicos canales judiciales plenamente vigentes para combatirla.
No faltan quienes ven en el emplazamiento la “desesperación” del gremio de juzgadoras y juzgadores por mantener supuestos “privilegios” pasando por alto la argumentación de la titular del Juzgado Décimo Noveno de Distrito en Veracruz (con sede en Coatzacoalcos), Nancy Juárez Salas:
El 12 de septiembre –recuerda– otorgó un amparo para evitar la publicación de la reforma, pero tres días después (15 del mismo mes) el entonces presidente López Obrador ordenó que apareciera en el Diario Oficial de la Federación.
