La reciente discusión y aprobación de la reforma constitucional en materia de Poder Judicial tiene implicaciones profundas en diversos ámbitos, desde lo jurídico hasta lo económico, con graves afectaciones a instituciones y principios democráticos, así como en la independencia y autonomía del Poder Judicial. Resulta muy preocupante que el apresurado proceso legislativo impulsado por Morena tanto en las cámaras de Diputados y Senadores como en los Congresos Locales, no solo careció de un análisis adecuado, sino que también se violentó el derecho humano a la seguridad jurídica y a la garantía de legalidad. Las leyes deben provenir de un proceso legislativo válido, como ha señalado la Suprema Corte de Justicia de la Nación (SCJN), lo que no se cumplió en este caso.
El principio de democracia deliberativa, considerado como rector del proceso legislativo, fue ignorado, y no se permitió la participación de fuerzas minoritarias representadas en el Congreso de la Unión y los Congresos Locales. Esto resulta escandaloso, ya que se limitó la posibilidad de que las minorías pudieran incidir de manera significativa en el debate. También se vulneró el derecho de los legisladores de ejercer su función pública en condiciones de igualdad, lo que debilita aún más el proceso democrático.
Esa misma limitación ha sido sufrida por personas integrantes del Poder Judicial Federal, a quienes se les negó su derecho de participar en defensa de sus derechos.
A nivel material, la reforma judicial vulnera el derecho humano de acceso a la justicia. El Ejecutivo federal y legisladores de Morena ignoraron la urgente necesidad de reforzar las capacidades de las autoridades policiales, ministeriales y judiciales locales, lo que tendrá como consecuencia la permanente incapacidad de que en muchos estados se imparta debidamente justicia pronta y expedita. Además, el país enfrenta una alarmante escasez de jueces, y la reforma no aborda de manera efectiva el rezago judicial.
